Kryetari i K\u00ebshillit Drejtues, Ilir Zela, thot\u00eb n\u00eb nj\u00eb intervist\u00eb p\u00ebr \u201cScan Magazine\u201d se Autoriteti i Komunikimeve Elektronike dhe Postare nuk do t\u00eb lejoj\u00eb m\u00eb n\u00eb t\u00eb ardhmen p\u00ebrdorimin e k\u00ebtyre formave t\u00eb konkurrenc\u00ebs s\u00eb pandershme, si \u00e7mimet grabitqare apo \u201cefekti club\u201d, p\u00ebrmes t\u00eb cilave operator\u00ebt m\u00eb t\u00eb m\u00ebdhenj \u00e7ojn\u00eb drejt falimentimit ata m\u00eb t\u00eb vegj\u00ebl. Cilat vler\u00ebsoni se jan\u00eb sfidat dhe objektivat kryesor\u00eb t\u00eb mandatit tuaj drejtues?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">N\u00ebse kthehemi n\u00eb histori, Shqip\u00ebria ka pasur shum\u00eb prapambetje, mes t\u00eb tjerash, edhe n\u00eb fush\u00ebn e komunikimit. Gjurm\u00eb t\u00eb k\u00ebsaj prapambetjeje duken edhe sot. N\u00ebse kalon n\u00eb akset kryesore, ende mund t\u00eb gjesh gjurm\u00ebn e sistemit t\u00eb vjet\u00ebr me shtylla dhe tela. Sot, situata \u00ebsht\u00eb m\u00eb e p\u00ebrmir\u00ebsuar, n\u00eb kuptimin q\u00eb p\u00ebrgjith\u00ebsisht njer\u00ebzit i g\u00ebzojn\u00eb sh\u00ebrbimet e komunikimit. N\u00ebse dikur kishim tarifa t\u00eb larta, p\u00ebr t\u00eb keq, marzhi i siguruar nga operator\u00ebt q\u00eb ishin n\u00eb gjendje t\u00eb mbanin tarifa aq t\u00eb larta, nuk \u00ebsht\u00eb p\u00ebrdorur n\u00eb mas\u00ebn e duhur p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar infrastruktur\u00ebn e komunikimeve elektronike. Nuk jemi t\u00eb k\u00ebnaqur me penetrimin e fibr\u00ebs optike; nuk jemi t\u00eb k\u00ebnaqur me konektivitetin n\u00eb premisat e pajtimtar\u00ebve, qofshin biznese apo familjar\u00eb; nuk jemi t\u00eb k\u00ebnaqur me nivelin aktual t\u00eb investimeve, nuk jemi t\u00eb k\u00ebnaqur me shkall\u00ebn e p\u00ebrdorimit t\u00eb teknologjive t\u00eb reja. Ndaj mund t\u00eb them se sfida kryesore sot p\u00ebr sektorin \u00ebsht\u00eb si shtojm\u00eb investimet n\u00eb k\u00ebt\u00eb sektor, q\u00eb Shqip\u00ebria t\u00eb kaloj\u00eb nga nj\u00eb prapambetje relative n\u00eb nj\u00eb nivel t\u00eb krahasuesh\u00ebm me vendet e Bashkimit Europian. Objektivi i BE \u00ebsht\u00eb q\u00eb brenda vitit 2020 100% e popullsis\u00eb t\u00eb marr\u00eb internet me 30 Mbps dhe shpejt\u00ebsi akoma m\u00eb t\u00eb lart\u00eb p\u00ebr 80% t\u00eb popullsis\u00eb. Kjo lidhet sigurisht me investimet, me aft\u00ebsit\u00eb q\u00eb ka sistemi i komunikimeve elektronike p\u00ebr t\u00eb mb\u00ebshtetur rritjen n\u00eb t\u00eb gjith\u00eb sektor\u00ebt e tjer\u00eb.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Shqip\u00ebria ngelet ende nj\u00eb vend i prapambetur, sidomos p\u00ebr sa i takon dep\u00ebrtimit t\u00eb linjave fikse. Si mund t\u00eb nxiten investimet n\u00eb k\u00ebt\u00eb drejtim?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Nuk ka nj\u00eb formul\u00eb magjike. Ajo ku un\u00eb besoj, edhe n\u00eb frym\u00ebn e ligjit \u201cP\u00ebr komunikimet elektronike\u201d \u00ebsht\u00eb tregu i lir\u00eb, konkurrenca. Prioriteti im i par\u00eb \u00ebsht\u00eb sigurisht nxitja e investimeve. N\u00eb mesin e muajit shkurt ne hap\u00ebm konsultimin publik p\u00ebr brezat e dividentit digjital. Kjo do t\u00eb thot\u00eb se do t\u00eb v\u00ebm\u00eb n\u00eb dispozicion t\u00eb industris\u00eb m\u00eb shum\u00eb spekt\u00ebr, p\u00ebr t\u00eb investuar dhe p\u00ebr t\u00eb rritur cil\u00ebsin\u00eb e sh\u00ebrbimeve t\u00eb internetit p\u00ebr pajtimtar\u00ebt e rrjeteve t\u00eb l\u00ebvizshme ose fikse. Edhe dallimi mes sh\u00ebrbimeve fikse dhe t\u00eb l\u00ebvizshme po ngushtohet gjithmon\u00eb e m\u00eb tep\u00ebr dhe po shkohet drejt nj\u00eb konvergjence.<\/p>\n\n<p class=\"wp-block-paragraph\">Prioriteti i dyt\u00eb \u00ebsht\u00eb konkurrenca. Rritja e investimeve arrihet pik\u00ebrisht duke e b\u00ebr\u00eb tregun m\u00eb konkurrent dhe duke i nxitur aktor\u00ebt e tregut q\u00eb t\u00eb jen\u00eb m\u00eb inovativ\u00eb. Operator\u00ebt nuk duhet t\u00eb bazohen n\u00eb modele biznesi ndonj\u00ebher\u00eb t\u00eb vjet\u00ebruara, por t\u00eb synojn\u00eb m\u00eb t\u00eb mir\u00ebn q\u00eb ofron teknologjia. Kjo lidhet edhe me eficienc\u00ebn ekonomike. Fakti sesa \u00ebsht\u00eb n\u00eb gjendje prodhimi i nj\u00eb tregu q\u00eb t\u00eb rritet varet, s\u00eb pari, nga struktura e atij tregu. N\u00ebse kemi nj\u00eb struktur\u00eb konkurrenciale, edhe prodhimi do t\u00eb jet\u00eb m\u00eb i lart\u00eb, ineficiencat do t\u00eb jen\u00eb m\u00eb t\u00eb ul\u00ebta dhe mund\u00ebsit\u00eb p\u00ebr investime do t\u00eb jen\u00eb m\u00eb t\u00eb m\u00ebdha. Nga ana tjet\u00ebr, kjo k\u00ebrkon edhe vet\u00ebdije publike, sepse jo n\u00eb \u00e7do zon\u00eb t\u00eb vendit nevojat p\u00ebr investime mund t\u00eb p\u00ebrmbushen nga mekanizmat e tregut. Ka zona ku investimet nuk jan\u00eb t\u00eb justifikuara n\u00eb k\u00ebndv\u00ebshtrimin komercial. N\u00eb k\u00ebto zona nevojitet edhe nj\u00eb mb\u00ebshtetje publike, n\u00eb nj\u00eb form\u00eb apo n\u00eb nj\u00eb tjet\u00ebr, p\u00ebr t\u00eb garantuar nj\u00eb zhvillim t\u00eb balancuar t\u00eb gjith\u00eb sistemit t\u00eb telekomunikacioneve n\u00eb vend.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Operator\u00ebt celular\u00eb, me koordinimin e AKEP, kan\u00eb n\u00ebnshkruar nj\u00eb marr\u00ebveshje p\u00ebr mbulimin me sh\u00ebrbim\u00a0<em>broadband<\/em>\u00a0t\u00eb zonave ku nuk ka interes komercial. A ka pasur deri tani rezultate nga kjo marr\u00ebveshje?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">\u00cbsht\u00eb nj\u00eb shqet\u00ebsim shum\u00eb i drejt\u00eb. Marr\u00ebveshja \u00ebsht\u00eb nj\u00eb \u00e7\u00ebshtje e vullnetit t\u00eb mir\u00eb, por nuk \u00ebsht\u00eb e mjaftueshme. Nd\u00ebr m\u00ebnyrat p\u00ebr t\u2019i mbuluar me sh\u00ebrbim zonat komercialisht joatraktive jan\u00eb detyrimet e licencave t\u00eb operator\u00ebve. AKEP ka b\u00ebr\u00eb disa p\u00ebrpjekje q\u00eb k\u00ebto detyrime licencash t\u00eb zbatohen dhe jemi duke shtuar nj\u00eb sens rigoroziteti n\u00eb k\u00ebto detyrime. Nj\u00eb nd\u00ebr masat e para t\u00eb planifikuara edhe n\u00eb planin e veprimit gjat\u00eb vitit 2018 \u00ebsht\u00eb pik\u00ebrisht imponimi i zbatimit t\u00eb kushteve t\u00eb licencave nga operator\u00ebt aktual\u00eb. Ka disa zona n\u00eb Shqip\u00ebri ku mbulimi me rrjet mungon ose \u00ebsht\u00eb shum\u00eb i dob\u00ebt dhe operator\u00ebt jan\u00eb n\u00eb moszbatim t\u00eb detyrimeve n\u00eb licencat e tyre. Ligji parashikon edhe sanksione, ndaj ne nuk do t\u00eb hezitojm\u00eb t\u2019i p\u00ebrdorim, n\u00ebse operator\u00ebt nuk do t\u00eb punojn\u00eb p\u00ebr t\u00eb ofruar sh\u00ebrbim n\u00eb k\u00ebto zona. Ne nuk mund t\u00eb lejojm\u00eb zhbalancime, vet\u00ebm sepse ndonj\u00eb operator nuk ka interes t\u00eb zbatoj\u00eb kushtet e licenc\u00ebs. P\u00ebr shembull, n\u00ebse qeveria investon miliona p\u00ebr t\u00eb nd\u00ebrtuar rrug\u00ebn p\u00ebr n\u00eb Vermosh, \u00ebsht\u00eb e papranueshme q\u00eb operator\u00ebt t\u00eb mos zbatojn\u00eb kushtet e licencave dhe t\u00eb mos ofrojn\u00eb sh\u00ebrbim n\u00eb k\u00ebto zona.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Kur besoni se do t\u00eb tenderohen autorizimet p\u00ebr p\u00ebrdorimin e brezit 800 Mhz?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Pjesa m\u00eb e v\u00ebshtir\u00eb, lirimi i k\u00ebtij brezi, tashm\u00eb \u00ebsht\u00eb kaluar. Tani jemi n\u00eb momentin kur duhet t\u00eb ndjekim hapat e p\u00ebrcaktuar n\u00eb ligj p\u00ebr nj\u00eb proces transparent tenderimi. Nuk do t\u00eb kemi vonesa p\u00ebrtej afateve q\u00eb na i k\u00ebrkon ligji. Pas konsultimit publik dymujor, AKEP ka afat nj\u00eb muaj p\u00ebr t\u2019i propozuar ministrit p\u00ebrgjegj\u00ebs nj\u00eb vler\u00eb dysheme p\u00ebr tenderin. Pasi ministri ta miratoj\u00eb, pastaj nuk ka m\u00eb pengesa p\u00ebr hapjen e tenderit. Nd\u00ebrkoh\u00eb, jemi duke punuar, n\u00eb bashk\u00ebpunim me Ministrin\u00eb e Financave dhe at\u00eb t\u00eb Infrastruktur\u00ebs, p\u00ebr t\u00eb rritur interesin e investitor\u00ebve potencial\u00eb rreth k\u00ebtij spektri.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Pra, nuk e shihni si nj\u00eb gar\u00eb t\u00eb kufizuar mes operator\u00ebve ekzistues?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Jo, aspak. P\u00ebrkundrazi, nj\u00eb nga m\u00ebnyrat e rritjes s\u00eb konkurrenc\u00ebs \u00ebsht\u00eb shtimi i numrit t\u00eb aktor\u00ebve. N\u00ebse do t\u00eb kemi hyrje t\u00eb operator\u00ebve t\u00eb rinj, ky do t\u00eb jet\u00eb nj\u00eb zhvillim shum\u00eb i sh\u00ebndetsh\u00ebm p\u00ebr tregun.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Q\u00eb prej vitit 2016, sh\u00ebrbimi i portabilitetit pothuajse \u00ebsht\u00eb bllokuar nga operator\u00ebt celular\u00eb. Si po e ndjek AKEP k\u00ebt\u00eb problem?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Kjo na sjell te kolona e tret\u00eb e veprimtaris\u00eb s\u00eb AKEP dhe q\u00eb \u00ebsht\u00eb mbrojtja rigoroze e t\u00eb drejtave t\u00eb pajtimtar\u00ebve t\u00eb sh\u00ebrbimeve t\u00eb komunikimeve elektronike. Ne po b\u00ebjm\u00eb, as m\u00eb pak dhe as m\u00eb shum\u00eb, nga sa thot\u00eb ligji \u201cP\u00ebr komunikimet elektronike\u201d. \u00cbsht\u00eb e drejt\u00eb e pajtimtarit q\u00eb numri i tij t\u00eb portohet brenda 24 or\u00ebve nga dor\u00ebzimi i k\u00ebrkes\u00ebs. P\u00ebr k\u00ebt\u00eb nuk duhet t\u00eb ekzistoj\u00eb asnj\u00eb lloj shfaj\u00ebsimi nga operator\u00ebt. Kemi amenduar rregulloren e portabilitetit dhe angazhohemi ta b\u00ebjm\u00eb bartjen e numrit brenda 24 or\u00ebsh, si\u00e7 ndodh edhe n\u00eb Itali. Pajtimtari do t\u00eb shkoj\u00eb te operatori marr\u00ebs dhe do t\u2019i jepet koha e sakt\u00eb kur k\u00ebrkesa e tij \u00ebsht\u00eb hedhur n\u00eb sistem. Megjithat\u00eb, ky ishte nj\u00eb vendim i aksioner\u00ebve t\u00eb shoq\u00ebris\u00eb. Ne jemi p\u00ebrpjekur ta administrojm\u00eb sa m\u00eb mir\u00eb k\u00ebt\u00eb proces. P\u00ebr ne \u00ebsht\u00eb nj\u00eb privilegj q\u00eb Autoriteti i Konkurrenc\u00ebs e ka analizuar nj\u00eb situat\u00eb t\u00eb till\u00eb dhe na ka v\u00ebn\u00eb n\u00eb dispozicion gjetjet e veta. Ne do t\u2019i p\u00ebrmbahemi me rigorozitet rrug\u00ebs ligjore dhe nuk do t\u00eb lejojm\u00eb q\u00eb asnj\u00eb pal\u00eb ta ndikoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb jasht\u00ebligjshme k\u00ebt\u00eb vendimmarrje, p\u00ebr interesat e veta. Detyra ligjore e AKEP \u00ebsht\u00eb t\u00eb vendos\u00eb masat ligjore proporcionale, p\u00ebr t\u00eb siguruar konkurrenc\u00eb dhe investime n\u00eb tregjet e sh\u00ebrbimeve t\u00eb komunikimeve elektronike. Detyra jon\u00eb \u00ebsht\u00eb q\u00eb vendi t\u00eb ket\u00eb nj\u00eb autoritet rregullator t\u00eb pavarur, modern, q\u00eb t\u00eb jet\u00eb n\u00eb gjendje t\u00eb zbatoj\u00eb ligjin n\u00eb m\u00ebnyr\u00eb t\u00eb balancuar dhe t\u00eb ndjek\u00eb standardet m\u00eb t\u00eb larta t\u00eb rregullimit t\u00eb k\u00ebtyre tregjeve. Gjith\u00e7ka tjet\u00ebr \u00ebsht\u00eb e kuptueshme n\u00eb pazarin e interesave bizneso-politiko-mediatike q\u00eb kan\u00eb ekzistuar p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb n\u00eb Shqip\u00ebri.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Kur do t\u00eb ket\u00eb nj\u00eb vendimmarrje lidhur me k\u00ebt\u00eb \u00e7\u00ebshtje?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">AKEP ka vendimmarrje t\u00eb vazhdueshme. Analiza e tregut t\u00eb terminimit \u00ebsht\u00eb objekt i vendimmarrjes prej disa jav\u00ebsh. Po kaq e r\u00ebnd\u00ebsishme \u00ebsht\u00eb t\u00eb analizohen dhe tregjet e tjera, si tregu i pakic\u00ebs, i akses-origjinimit apo i terminimit t\u00eb thirrjeve nd\u00ebrkomb\u00ebtare. Kombinimi i k\u00ebtyre analizave do t\u00eb na jap\u00eb edhe konkluzionet e duhura, lidhur me masat e nevojshme p\u00ebr t\u00eb korrigjuar deformimet e konkurrenc\u00ebs n\u00eb k\u00ebto tregje. \u00cbsht\u00eb nj\u00eb analiz\u00eb komplekse, p\u00ebr t\u00eb cil\u00ebn jemi mb\u00ebshtetur me konsulenc\u00eb nga fondet e Bashkimit Europian dhe BERZH. N\u00ebse do t\u00eb ekzistoj\u00eb nj\u00eb instrument efikas n\u00eb nivel shumice, p\u00ebr t\u00eb mos pasur sjellje strategjike, me diferencime\u00a0<em>on net-off net<\/em>, at\u00ebher\u00eb nuk do t\u00eb ishte e nevojshme t\u00eb nd\u00ebrhynim n\u00eb tregun me pakic\u00eb. Masat n\u00eb nivel shumice q\u00eb p\u00ebrdoren nga rregullator\u00ebt e vendeve q\u00eb kan\u00eb pasur probleme t\u00eb tilla jan\u00eb testet e \u00e7mimeve grabitqare dhe shtrydhjes s\u00eb marzhit\u00a0<em>ex ante<\/em>.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Megjithat\u00eb, \u00ebsht\u00eb pothuajse e paprecedent q\u00eb, p\u00ebr nj\u00eb operator t\u00eb pranish\u00ebm n\u00eb treg prej rreth 10 vjet\u00ebsh, si\u00a0<\/strong>\u201c<strong>Eagle Mobile<\/strong>\u201c<strong>, t\u00eb lejohet ende nj\u00eb asimetri n\u00eb tarifat e terminimit.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Mund t\u00eb duket k\u00ebshtu, por ka shembuj q\u00eb asimetria p\u00ebr nj\u00eb periudh\u00eb kohore aplikohet dhe kjo njihet edhe n\u00eb dokumentet e BEREC, nj\u00eb instrument i Komisionit Europian. Ne nuk kemi monopolin e dijes dhe t\u00eb kriterit t\u00eb s\u00eb v\u00ebrtet\u00ebs. Gjith\u00e7ka \u00ebsht\u00eb e hapur p\u00ebr diskutime dhe k\u00ebndv\u00ebshtrime t\u00eb ndryshme, por, ne nuk mund t\u00eb heqim dor\u00eb nga vendimmarrja p\u00ebr hir t\u00eb k\u00ebtyre diskutimeve apo pik\u00ebpamjeve divergjente. Nuk lejojm\u00eb q\u00eb struktura e tregut t\u00eb hidhet n\u00eb er\u00eb dhe t\u00eb p\u00ebrfundojm\u00eb n\u00eb situata monopolistike.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Mes operator\u00ebve celular\u00eb ka nj\u00eb luft\u00eb t\u00eb vazhdueshme marketingu lidhur me parametrat e cil\u00ebsis\u00eb s\u00eb sh\u00ebrbimit, sidomos t\u00eb lidhur me shpejt\u00ebsin\u00eb e internetit\u00a0<em>broadband<\/em>.
